We reserve the right to undertake legal or other actions, including claims for damages as we see fit, based on our sole discretion, under such circumstances.

When accessing and using the website www.effistride.com and its related subdomains and event websites, you are prohibited from:

• Violating any laws, statutes, ordinances, or regulations.
• Utilizing the Service (or any part thereof) for unlawful purposes, agreeing to use it in compliance with all applicable laws.
• Promoting illegal activities, inciting physical harm or injury against any group or individual, or promoting or disseminating information about illegal activities.
• Uploading or disseminating any computer viruses, macro viruses, Trojan horses, worms, or any other harmful activities through the Service.
• Removing any copyright, trademark, or other proprietary notices from the Website or the Online Conference.
• Modifying, creating derivative works from, copying, or storing a significant portion of the Website or Online Conference or any related technology, except as permitted by law or expressly authorized by us.
• Bypassing any security feature of the Website or compromising the security of your or another’s account.
• Interfering with or overloading the Website’s operations (e.g., with viruses, denial of service attacks, or gaming algorithms).
• Employing manual or automated software, devices, or other processes to access, scrape, or crawl the Website or any content or information contained therein.
• Engaging in framing, mirroring, or otherwise simulating the appearance or function of the Website.
• Using recording equipment or other devices to record the Online Conference.
• Utilizing the Website in a way that could interrupt, damage, make it less efficient, or interfere with the normal operating procedures of a computer or the Website.
• Sharing material that is unlawful, libelous, obscene, discriminatory, harmful, fraudulent, deceptive, threatening, harassing, defamatory, vulgar, invasive of privacy, hateful, or otherwise objectionable.
• Impairing the functionality of the Website or the Online Conference.
• Violating or infringing on the rights of any individual, firm, or company, including intellectual property, confidentiality, and/or privacy rights.

Usage and handling of Personal Data for Marketing Objectives

Effistride s.r.o. commits to not disclosing your postal or email addresses, credit card details, or any personal information to third parties without your explicit consent. By this statement, I authorize Effistride s.r.o. to retain the following categories of data for internal use:

• Required and optional information gathered at the time of ticket purchase.
• Required and optional information collected upon registration for a free admission ticket, including the registration date.
• Voluntary information provided during participation in online surveys.
• Information obtained from any linked social media accounts, for which I have given clear prior consent.
• Should I provide my mobile phone number, I allow Effistride s.r.o. or its subsidiaries to contact me via SMS regarding events for which I am buying a ticket or expressing interest.
• I understand that my information might be used by Effistride s.r.o. for marketing purposes to contact me via phone or email to gather feedback on services similar to those I have previously engaged with.
• I also consent to the use of my personal information for advertising purposes through mathematical and statistical analysis (scoring).
• Additionally, I consent to the enhancement and enrichment of my data with further information. Effistride s.r.o. is granted perpetual rights to use any photographs or video content produced by attendees at any of its organized summits without compensation.

Personal Information

By supplying personal details such as your name, email address, work address, telephone numbers, and other contact details through any of the event websites owned by Effistride s.r.o. or via email directly to Effistride s.r.o., you consent to Effistride s.r.o. for:

• Processing and managing your personal information to fulfill any of your requests or instructions.
• Maintaining a record of both incoming and outgoing communications (e.g., emails) to manage your personal information in accordance with this Privacy Statement.

Furthermore, Effistride s.r.o. may gather additional information about you, including:

• Details provided by completing forms on the websites.
• Your name and physical shipping, contact, and payment information.
• Email addresses and phone numbers.
• Date of birth.
• Tax identification or VAT number, where relevant.

Security

The safeguarding of your Personal Information holds significant importance for us. Nonetheless, it is acknowledged that no method of transmission via the Internet or electronic storage solution can be deemed entirely infallible. As such, although we are committed to employing commercially reasonable measures to protect your Personal Information, Effistride s.r.o. is unable to assure its absolute security and, consequently, cannot bear liability in instances where the security of your Personal Information is breached. Your personal information’s security remains a priority for us.

Refund & Cancellation Policy

All ticket purchases for summits and events, whether virtual or in-person, are final and non-refundable. Each ticket is the property of Effistride s.r.o. and constitutes a personal, revocable license which may be revoked and admission denied at any time, with a refund of the printed registration price being the sole remedy.

Any attempt by a company, organization, or individual to host or organize an event in association with, adjacent to, or claiming to be related to Effistride s.r.o. and its organised summits without the explicit prior approval and collaboration of Effistride s.r.o. is strictly prohibited. Violation of these terms will result in the immediate invalidation of any tickets purchased, and Effistride s.r.o. retains the right to pursue legal action, including claims for damages as deemed necessary.

Tickets are intended solely for the purchaser’s personal or business use and cannot be resold or transferred for any reason, including but not limited to promotional or competition purposes. Effistride s.r.o. reserves the right to cancel tickets without notice if there is any resale, attempted resale, or other breach of this condition.

We also reserve the right to cancel purchases made by anyone believed to be a ticket broker or scalper. Effistride s.r.o. retains the right to deny entry to any virtual or physical event or conference if attendee behavior is deemed unacceptable or if there is a breach of terms and conditions.

Effistride s.r.o. is not liable for lost or stolen tickets. The use of unauthorized photographic and recording equipment at events and conferences is forbidden. Attendees consent to being filmed and recorded as part of the audience.

Effistride s.r.o. and its subsidiaries accept no liability for any personal or property damage or loss, except in cases of death or personal injury caused by Effistride s.r.o.’s negligence, or where liability cannot be legally excluded or limited.

Effistride s.r.o. bears no responsibility for the issuance of visas required to attend any event or conference. Should a visa not be granted, tickets will not be refunded.

Name changes on tickets will be accommodated without charge, except within 7 days prior to the event start, after which the ticket price is non-refundable.

Event Cancellation, Postponement & Substitution Policy

Effistride s.r.o. bears no responsibility for any loss or damage resulting from the substitution, modification, cancellation, or delay of an event. Effistride s.r.o. disclaims all liability in the event that an event is canceled, rescheduled, or postponed due to a fortuitous event, Act of God, unforeseen event, or any other occurrence that makes the execution of an event impractical, unlawful, or unfeasible. For the purpose of this provision, a fortuitous event event shall encompass, but not be limited to, war, fire, labor strike, extreme weather conditions, or other emergencies.

It is important to acknowledge that while speakers and sessions are confirmed at the time of announcement, unforeseen circumstances beyond the control of the organizers may necessitate the substitution, alteration, or cancellation of speakers and/or sessions. Accordingly, Effistride s.r.o. retains the right to change or modify the advertised speakers and/or sessions as required without any obligation to you whatsoever. Any changes or modifications will be promptly communicated on our website.

FORCE MAJEURE CLAUSE

Our liability is not engaged should any of the events organised by Effistride s.r.o. be cancelled, delayed, or rescheduled in whole or in part, nor for any failure or delay in fulfilling our obligations as outlined in these Terms, due to circumstances beyond our reasonable control. Such circumstances include, but are not limited to: (a) disruptions in power or server functionality, (b) periods of updates or maintenance, (c) effects of war, Act of God, floods, droughts, earthquakes, or other natural disasters, (d) outbreaks of epidemic or pandemic, (e) acts of terrorism, civil unrest, riots, conflicts, threats of war, sanctions, embargos, or severance of diplomatic ties, (f) contamination by nuclear, chemical, or biological agents, or sonic disruptions, (g) actions or interventions by governmental or public authorities, (h) structural collapses, fires, explosions, or accidents, (i) labor disputes, strikes, industrial actions, or lockouts, (j) failures of suppliers or subcontractors to perform, and (k) interruptions or breakdowns in utility services, including failures in electronic or communication networks, or any other event that makes the execution of any of the events organised by Effistride s.r.o., in whole or in part, unfeasible, unlawful, or impossible.

We will endeavor to promptly notify you of any disruptions to the Service or Virtual Summit. In instances where the Online Service or Services are compromised due to factors beyond our control, we bear no liability towards you.

Governance

These terms and conditions are governed by Czech law, and any disputes arising from them shall be exclusively resolved in the jurisdiction of the courts of the Czech Republic.

General Provisions

Effistride s.r.o. reserves the right to delegate the responsibilities of fulfilling its obligations under this Agreement.

This Agreement is exclusive of any other terms, embodying the complete understanding and agreement between us regarding its subject matter, and supersedes all prior agreements, whether written or oral, concerning such matters. You acknowledge that in accepting these terms, you have not relied on any representation not explicitly included here, and you agree that you shall not have any remedy in respect of any unexpressed representation. Nonetheless, this does not intend to exclude any liability for any fraudulent statement or action.

Should any provision of these terms be determined to be illegal, void, or unenforceable for any reason, such provision shall be severable from these terms and shall not affect the validity and enforceability of the remaining provisions.

You agree not to:

• Engage in any illegal activities using the website, adhering to all applicable laws;
• Upload or transmit any malicious code or software through the website;
• Utilize the website in any way that could disrupt, damage, or impair its functionality or interfere with computer operations;
• Post or transmit any material that is defamatory, offensive, obscene, or causes annoyance, inconvenience, or anxiety; impair the website’s functionality; or infringe upon the rights of any entity or individual, including intellectual property, confidentiality, or privacy rights;
• Publish a hyperlink to any part of the website, or attempt unauthorized access to any portion of the website;
• Copy or distribute any part of the website without prior written consent;
• Make any modifications to the website, except as necessary for its intended use.

We reserve the right to:

• Temporarily or permanently modify or withdraw the website (or any part of it) without notice;
